While the world becomes more hegemonized socially and culturally, local communities are fighting to preserve their way of life as part of their heritage. Travel and cultural institutions use this "uniqueness" to promote travel and tourism; and while this brings in revenue and exposure, cultural heritage sites that were preserved by virtue of their isolation are now being severely damaged and even destroyed.

At the same time, there is a growing awareness that while this unique heritage is used to define a community, society or nation, it also can be a basis for conflict. The volume addresses a deeply political aspect of heritage preservation and management as it relates to human rights.

Social and community advocates assert that heritage is necessary for the articulation and preservation of cultural identity. The display of heritage monuments and performance can be a strategy for asserting minority identity in the face of majority pressure — as well as a tool for resistance and the expression of difference. Conversely, the erasure of cultural expressions—such as buildings, monuments, language, religion, and social practices—is a powerful tool in warfare and political regulation.

In the assault on human lives and political autonomy, the cultural history and values of a community are also attacked, destroying not only individuals but the very fabric of society. Is there a universal right to the free expression and preservation of cultural heritage, and if so, where is that right articulated and can it be protected? How is the notion of "heritage" used variously to unite and divide communities?

Who defines cultural heritage and who should control stewardship and the benefits of cultural heritage? Cultural Heritage and Human Rights, the first volume in the Cultural Heritage in a Globalized World series, use these issues and questions to contemplate cultural heritage and human rights. The cases presented are world-wide with their implications presented on a global level.

Human Rights

Human rights are rights inherent to all human beings, regardless of race, sex, nationality, ethnicity, language, religion, or any other status. Human rights include the right to life and liberty, freedom from slavery and torture, freedom of opinion and expression, the right to work and education, and many more. Everyone is entitled to these rights, without discrimination. One of the great achievements of the United Nations is the creation of a comprehensive body of human rights law—a universal and internationally protected code to which all nations can subscribe and all people aspire. The United Nations has defined a broad range of internationally accepted rights, including civil, cultural, economic, political and social rights.

On 10 December , the United Nations led worldwide celebrations to commemorate the sixtieth anniversary of the Universal Declaration of Human Rights. Six decades ago, the international community affirmed that the strength of shared ideas and a common vision of respectful and peaceful coexistence could prevail over brutality, hatred and destruction. Having risen from the sorrow and shame of atrocities perpetrated in the course of the Second World War, the Declaration represented, and continues to represent, one of humanity's most shining achievements. It enshrines the hope for a better world, where aspirations to freedom and well-being converge. The framers of the Declaration, who came from diverse countries and cultures, ultimately succeeded in delivering the first universal articulation of human rights and entitlements that make dignity, justice and equality possible for everyone everywhere.

Cultural Human Rights

In speaking of a right in relation to identity formation, I have avoided many important questions, including questions about how properly to understand identity formation itself. Evoking such a right does draw from existing trends, but it remains speculative. Nonetheless, it captures one valuable insight in criticisms of human rights as a Western imposition, namely the insight that an important kind of oppression figures in the imposition of identities. By affirming a human right in relation to identity formation, we can not only confront this kind of oppression but see that it has specific weight in contemporary globalizing politics, economics, and culture.

The Western cultural construct of human rights provides inherent and inalienable rights to all, regardless of culture and tradition. These cultural traditions, such as Sharia law and female circumcision, challenge the cultural foundations of human rights by providing alternative means of understanding the individual and their role in the broader community. Thirdly, an examination of Sharia law and human rights will be undertaken, demonstrating how the Western construct of human rights clashes with the non-Western construct of Sharia limiting the application of human rights.

The cultural rights movement has provoked attention to protect the rights of groups of people, or their culture , in similar fashion to the manner in which the human rights movement has brought attention to the needs of individuals throughout the world. Cultural Rights are rights related to art and culture, both understood in a large sense. The objective of these rights is to guarantee that people and communities have an access to culture and can participate in the culture of their selection.

Economic, social, and cultural rights include the human right to work, the right to an adequate standard of living, including food, clothing, and housing, the right to physical and mental health, the right to social security, the right to a healthy environment, and the right to education.

Human rights and cultural conflict
